Thoroughly Implementing Guidelines of the CPC for Leading Party Cadres to Ensure Clean Government Administration and Building Trust among the People through Progress in Improving the Work Style of the Party and Combating Corruption (Extract)

 In March 1997 the CPC Central Committee issued the Guidelines of the CPC for Leading Party Cadres to Ensure Clean Government Administration (Trial Version) in order to standardize the actions of leading Party cadres in government administration. It has now been 13 years since those guidelines were promulgated, and they have played an important role in promoting honesty and self-discipline among leading Party cadres and developing and improving the work style of the Party and strengthening and improving efforts to combat corruption and ensure clean government. Changes in the situation and tasks, in particular the deepening of efforts to improve the Party’s work style and ensure clean government and combat corruption, make it necessary to revise and improve these guidelines. The major strategic ideas and important principles and polices developed by the Central Committee for promoting the causes of the Party and state need to be better implemented in the effort to ensure clean government administration among leading Party cadres. Furthermore, the theories, lessons learned from actual practice and results of institutional improvement need to be more thoroughly applied in this effort. In addition, the many new lessons learned through actual experience and effective methods developed by all localities, government departments and enterprises and institutions, especially those at the local level, need to be further refined and upgraded to be common obligatory demands for all leading Party cadres. Finally, certain new situations and issues that have arisen related to clean government administration among leading Party cadres need to be addressed by new measures and methods.

 It was precisely to address these new situations, new tasks and new requirements that the Central Committee issued the revised Guidelines of the CPC for Leading Party Cadres to Ensure Clean Government Administration in January 2010, which amended and improved the rules of behavior of leading Party cadres to ensure clean government administration. These rules introduce higher standards and stricter requirements for leading Party cadres. These guidelines are another important set of regulations issued by the Central Committee concerning combating corruption and ensuring clean government coming on the heels of three important sets of regulations issued in 2009, including the Regulations of the CPC on Inspection Tour Work (Trial Version). Implementing the Guidelines of the CPC for Leading Party Cadres to Ensure Clean Government Administration will help to strengthen the specificity and efficacy of the education, management and supervision of leading Party cadres, promote clean and honest governance among leading Party cadres and ensure that they do even more to exercise their powers for the benefit of the Party and the people.

 I. We must fully understand the basic spirit and major content of the Guidelines of the CPC for Leading Party Cadres to Ensure Clean Government Administration in order to effectively address the major issues related to ensuring clean government and self-discipline among leading Party cadres.

 The revised Guidelines of the CPC for Leading Party Cadres to Ensure Clean Government Administration, which contain 18 articles grouped into 3 chapters, have three characteristics: One, they are a continuation of previous provisions but also contain new provisions. The revised regulations preserve the provisions of the former Guidelines of the CPC for Leading Party Cadres to Ensure Clean Government Administration (Trial Version) that are still applicable. In addition, the revised standards incorporate the latest requirements of the Central Committee for leading Party cadres to ensure clean government administration in light of the new situations and tasks and summarize and refine some beneficial lessons and methods that all localities, government departments and enterprises and institutions developed through actual experience. Care has been taken to ensure the revised standards are in line with other internal Party regulations and that they reflect institutional innovations designed to combat corruption and ensure clean government.

 The second characteristic of the revised guidelines is that they address both symptoms and root causes of corruption. They provide clear obligatory standards to ensure clean government administration among leading Party cadres under the current conditions, while also addressing both symptoms and root causes of corruption, taking a comprehensive approach and providing both punishment for offenses and prevention measures, with the emphasis on prevention. The revised guidelines provide for a number of policy measures designed to improve education and systems, strengthen oversight, deepen reform and tighten discipline to resolve major issues in efforts to ensure clean government administration among leading Party cadres by preventing and controlling the root causes of corruption. The guidelines organically integrate measures to treat symptoms and measures to address root causes, punishment and prevention, and self-discipline and external disciplinary measures in line with the need to set up a sound punishment and prevention system.

 The third characteristic of the revised guidelines is that they have both a theoretical and practical character. The general provisions define the ideals and beliefs that leading Party cadres should hold and the basic objectives they should pursue, and define theoretical requirements for adhering to Party discipline and obeying the laws of the state, correctly exercising their powers and maintaining a good work style. The following chapters define prohibited actions in government administration. There are a total of 52 specific prohibitions, grouped into 8 areas.

 In addition, the revised guidelines contain requirements for the work of implementation, ensuring that they will be very practicable and helping to improve their execution and effectiveness. We must carefully study and fully understand the basic spirit and major content of the Guidelines of the CPC for Leading Party Cadres to Ensure Clean Government Administration. We must further standardize the administrative actions of leading Party cadres in order to address major issues affecting efforts to ensure honesty and self-discipline among leading Party cadres through the implementation of these guidelines, taking an overall approach while focusing on key areas, and build trust among the people through progress in improving the work style of the Party and combating corruption.

 We must resolve the problem of leading Party cadres taking advantage of the authority of their position or official duties for illegitimate personal gain. We are a Marxist party dedicated heart and soul to serving the people. We only work in the interest of the working class and the overwhelming majority of the people and not for any special interests of our own. The powers of leading Party cadres, regardless of rank or position, are granted by the people and can only be used for the benefit of the people, never for personal gain. Article 1 and Article 3 of the guidelines prohibit leading Party cadres from using their authority or the influence of their position for illegitimate gain and clearly specify that they must strictly adhere to the regulations on the management of public assets. Leading Party cadres must carefully comply with these regulations, firmly resist illegitimately receiving cash and gifts in any form, firmly resist pursuing illegitimate interests in any form and firmly resist diverting public funds and assets for personal use. They must deny themselves for the public good and ensure clean and honest government. 

 We must resolve the problem of leading Party cadres personally engaging in profit-making activities. The CPC is not opposed to personal interests, but believes in carefully balancing personal interests with the interests of society, the state, the Party and the people. While safeguarding the public’s interests, the Party also allows individuals to pursue personal wealth through lawful channels. Party cadres, as public servants, all have a certain amount of government authority, and this authority can only be used to serve economic and social development and to serve the public. If a Party cadre uses his or her government authority to engage in profit-making activities for personal gain, the cadre blurs the line between government authority and personal interests, which leads to abuse of power for personal gain and could conflict with the interests of the people. To address this, Article 2 of the guidelines stipulates that, for instance, leading Party cadres may not engage in business or operate enterprises in their own names or in someone else’s name. It also provides that they may not possess the stocks or bonds of unlisted companies or enterprises in violation of regulations, they may not buy and sell stocks or invest in other types of securities in violation of regulations, they may not personally register a company overseas or outside the boundaries of the mainland of China or invest in the stocks of such companies, and they may not simultaneously hold a position in an economic entity or mass organization or simultaneously act as an agent for compensation. Leading Party cadres must carefully comply with the above regulations, firmly resist engaging in profit-making activities, dedicate themselves to effectively carrying out their duties and put serving the people first. 

 We must resolve the problem of leading Party cadres interfering in or influencing market economic activities in violation of regulations. One important objective of our reforms is to separate the functions of government from the operation of enterprises, separate government and capital, separate government and business, separate government and market brokerage organizations and constantly improve the socialist market economic system so that the market can fully play its fundamental role in allocating resources. Interfering in or influencing market economic activities on the part of leading Party cadres in violation of regulations not only threatens order in the market economy, violates the principle of fair competition and adversely affects economic and social development, but also leads to a great deal of corruption. Looking at the cases uncovered in recent years, a large number of cases of violation of the code of conduct or the law, especially large-scale and major cases, involve leading Party cadres using the authority of their position to influence market economic activities in violation of regulations. To address this situation, Article 7 of the guidelines strictly prohibits leading Party cadres from interfering in or influencing market economic activities in violation of regulations. For instance, leading Party cadres may not interfere with or influence the awarding of contracts for construction projects, transfer of land use rights, government procurement, real estate development and operation, development and use of mineral resources or agency services and economic activities such as enterprise reorganization and restructuring or production and operation. We must diligently comply with these regulations to truly resolve the problem of leading Party cadres interfering in or influencing market economic activities in violation of regulations. At the same time, we must accelerate efforts to make the government more service-oriented, reduce the number of and standardize items requiring administrative approval and reduce influence peddling by deepening reform and improving institutions, thus preventing the occurrence of such problems by addressing the root causes. 

 We must resolve the problem of leading Party cadres using the influence of their authority or responsibilities in the interest of their relatives or staff. It is normal to care for one’s family, relatives and friends, but for all leading Party cadres it is worth carefully and soberly considering who to care for and how to care for them. Some leading cadres are not able to properly handle the requests of relatives and friends and some even use the influence of their authority or responsibilities to illegitimately advance the interests of relatives and friends. This can not only lead to jail time for the involved cadres, but in the end, harm their relatives and friends as well, a profound lesson to learn. To address this, Article 5 contains regulations covering 8 aspects of the problem. Leading Party cadres must carefully adhere to these regulations, correctly recognize and handle requests from relatives and friends, stick to the principles, handle all matters fairly and do not do favors for friends. They should tighten management of their relatives and staff and not allow them to pursue personal interests through the influence of their position or authority. If it is discovered that relatives or staff are violating the code of conduct or the law, such action should be immediately terminated. Leading cadres should not allow their relations with others to lead to mistakes or get into trouble. 

 We must resolve the problem of leading Party cadres selecting and appointing cadres in violation of regulations. The Central Committee has been carrying out vigorous reform of the cadre personnel system in recent years and has formulated a number of institutional regulations to improve cadre education and training, testing and evaluation, selection and recruitment, and management and oversight. These measures have proven to be very effective. Article 4 of the guidelines clearly prohibits leading Party cadres from selecting and appointing cadres in violation of regulations. Party cadres, especially all levels of leading cadres, must carefully adhere to these regulations. They should maintain a correct outlook on their authority, position, and interests, ensure there are no improprieties in their promotion and resignation and retention and transfer, strictly abide by the code of conduct, always consider the big picture and conscientiously abide by organizational arrangements and the choices of the public. At the same time, they should adhere to the Party line for cadres and standards for personnel, correctly handle the selection and use of cadres, uphold democratic principles, use personnel in a fair and normal manner, strictly follow the specified conditions and protocol in selecting and appointing personnel, and truly select and employ personnel for the good of the Party and the people. 

 We must resolve the major problems affecting the work style of leading Party cadres. For leading Party cadres, an excellent work style is an important tool to ensure vigorous progress and improvement, and a poor work style is often a cause and precursor leading to extravagant pursuit of pleasure and corruption. Article 6 and Article 8 of the guidelines forbid pompousness, a lavish lifestyle, squandering of public funds and extravagance and waste, as well as ignoring reality, falsifying documents and other actions that harm the interests of the public or relations between Party members and non-Party members and between cadres and ordinary people. We must combine adherence to these regulations with efforts to meet the requirements of General Secretary Hu Jintao for leading cadres to strengthen their advanced Party nature and develop and promote an excellent work style, and with the requirement of the Fourth Plenary Session of the Seventeenth CPC Central Committee to form closer ties with the people, seek the truth and be pragmatic, work hard and engage in criticism and self-criticism. We must promote significant improvement in the work style of leading Party cadres through better education, institutional improvement and stronger oversight on the part of Party organizations and more theoretical study, greater practical experience and more strict self-discipline on the part of leading Party cadres. Improvement in the work style of the Party will benefit both the government and the people. 

 II. We must carefully follow the guidelines to truly improve institutional efficacy.

 Leading Party cadres must start with their own actions and carefully implement the guidelines to ensure clean government administration. All levels of Party organizations must diligently implement the guidelines and the individual leading Party cadres carefully adhere to them in order to ensure that all obligations and regulations of the guidelines are properly implemented and that they truly become the code of behavior for ensuring that leading Party cadres administer the government for the people, are clean and honest and work for the public good, and that they are effective in combating corruption and ensuring clean government and holding the Party together and winning the support of the people.

 We need to improve organization and leadership. All levels of Party committees and government must fully recognize the importance and urgency of implementing the guidelines. They must view implementation of the guidelines as an important task in the effort to improve the Party's work style and ensure clean government for the present and some time to come, make it an important item on their agenda, clearly define duties and tasks, make detailed work plans, strengthen supervision and inspection, and concentrate on carrying out the work. The main responsible leading cadres of the Party and government should diligently adhere to the responsibility system for improving the work style of the Party and ensuring clean government, truly take on their responsibilities as the primary responsible persons, take overall responsibility for the work in their individual jurisdictions and be personally involved in the work. Other leaders should carry out the duties assigned to them in the designated area. They should always remain grounded in reality, carefully identify the major problems and weak links in the effort to ensure clean government administration among leading Party cadres in their individual jurisdictions in reference to the relevant provisions of the guidelines, and take effective measures to resolve them. All levels of discipline inspection agencies should fully carry out their duties, strengthen coordination among organizations, actively assist Party committees and government in the work of implementing the guidelines. 

 We must intensify publicity and education efforts. We must view study, publicity and education regarding the guidelines as an important part of current publicity and education work to fight corruption and ensure clean government, incorporate it in the study activities of the Party committee central group for theoretical study, include it in teaching plan for all levels of Party schools, administrative academies and other cadre training facilities and organize study sessions for Party cadres in a variety of forms so that they gain a full understanding of the basic obligations and major provisions of the guidelines and become more conscientious in implementing them. The study of the guidelines should be combined with study of the Party Constitution, Regulations on Internal Party Oversight (Trial Version) and other laws and regulations to encourage Party cadres to be more conscientious in working for clean government administration. We must make full use of the media, including radio, television, periodicals and the Internet to publicize the guidelines so that the general public can correctly understand the current situation in the fight against corruption and efforts to ensure clean government and know that the Party strictly manages its affairs and is firmly resolved to improve the Party's work style, ensure clean government and fight corruption, thereby creating an excellent atmosphere in society for fighting corruption and ensuring clean government. 

 We must formulate more support regulations. The effort to ensure clean government administration among leading Party cadres involves all aspects of economic and social life. The guidelines are basic regulations directed at the entire Party designed to combat corruption and ensure clean government, so many of the obligations and provisions are general and in the form of a principle rather than being specific and covering all cases. We must improve the system of support regulations to ensure that the guidelines are effectively implemented. First, the regulations need to be made more detailed. The CPC Central Commission for Discipline Inspection needs to formulate implementation methods for the guidelines as soon as possible to clarify the legal basis, specific cases, scope of applicability, how to handle cases and operational protocol for the guidelines to ensure that the guidelines can be put into operation. All localities, government departments and enterprises and institutions should formulate specific opinions on implementation of the guidelines based on their actual working conditions. Second, we must review current regulations. Those that are still applicable should be retained, those that are not entirely applicable should be carefully revised and improved and those that are fundamentally flawed should be rescinded. We need to gradually set up a system of regulations to ensure clean government administration among leading Party cadres centered around the guidelines that supports regulations related to the fight against corruption and efforts to ensure clean government and that is compatible with the socialist market economic system. Three, we must make innovations in the system of regulations. We must carefully review the latest experience of all localities, government departments and enterprises and institutions, especially those at the local level, actively borrow from methods successfully applied in other countries and constantly deepen reform and make innovations in the system of regulations to resolve the deep-rooted issues and problems affecting efforts to ensure clean government administration among leading Party cadres to eliminate to the greatest extent the ground that allows corruption to emerge and grow. 

 The main responsible Party cadres must set an example in implementing the guidelines to promote clean governance. The main responsible leading cadres at all levels are key in this effort. The main responsible leading cadres at all levels should set an example in implementing the guidelines by setting their standards higher and being more strict in fulfilling their obligations. The main responsible Party cadres must set an example in studying the guidelines to become familiar with and understand all the regulations and obligations outlined in the guidelines and become firmly aware that everyone is equal before the law, that no one has special privileges with respect to the regulations and that everyone is subject to regulatory limits. The main responsible leading Party cadres must set an example in implementing the guidelines by being the first to meet the obligations defined for ordinary leading Party cadres. Leaders at higher levels must first meet the obligations defined for lower lever leaders and must first meet the obligations defined for others. The main responsible leading Party cadres must set an example in accepting oversight by actively participating in democratic meetings and reporting on their work and their efforts to perform their duties honestly. They should report to Party organizations on matters pertaining to themselves, make acceptance of oversight the normal state of affairs in their work and lives, and become accustomed to oversight for the exercise of their powers and conduct of their work. 

 We must improve oversight and inspection. All levels of Party committees, government authorities and discipline inspection agencies should promote implementation of the guidelines by improving oversight and inspection, strengthening efforts to track responsibility and strictly enforcing discipline. One, they should carry out concentrated inspections. The CPC Central Commission for Discipline Inspection and the Ministry of Supervision should carry out concentrated inspections to determine how well the guidelines are being implemented, discover problems as they emerge and promptly begin promoting resolution of problems. All localities, government departments and enterprises and institutions should organize corresponding inspections and promote implementation. Two, we must strengthen routine oversight. We must take full advantage of the  role of all types of internal Party oversight systems to gain a full understanding of how well the guidelines are being implemented and how well leading Party cadres are ensuring clean government administration so we can uncover corresponding problems as they emerge and promptly resolve them. Three, we must expand oversight channels. We must be sure to take advantage of the oversight role of the National People's Congress and CPPCC, the public and the media, and coordinate oversight resources to form a concerted oversight effort. Four, we must exercise strict discipline. The work of investigating and handling cases must be intensified and leading Party cadres that violate the provisions of the guidelines should be subject to criticism, education, or organizational or disciplinary measures in accordance with the severity of the violation and the relevant regulations. If the case involves criminal actions, those involved should be prosecuted in accordance with the law. We should also select some typical cases and publicize their handling as an effective warning to others.
